2. The Services
MindSpectre provides software and tools that may include AI-assisted features related to website creation, SEO, content generation, analytics, and workflow automation. The Services may change over time.
3. Accounts
If you create an account, you agree to:
- Provide accurate and complete information.
- Keep your credentials confidential.
- Promptly notify us of any unauthorized access.
You are responsible for all activity under your account.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, or fraudulent purposes.
- Attempt to reverse engineer, disrupt, or interfere with the Services.
- Abuse rate limits or access the Services using automated means that degrade performance.
- Upload or generate content that infringes intellectual property rights or violates applicable law.
- Use the Services to send spam or malicious code.
We may suspend or terminate access if we reasonably believe you violated these Terms.
5. User Content and Generated Content
Your content
You retain ownership of content you submit to the Services (“User Content”). You grant us a limited license to host, process, and display User Content solely to provide and improve the Services.
Generated output
If the Services generate content (“Output”), you may use the Output for your lawful business purposes. You are responsible for reviewing Output for accuracy, compliance, and suitability.
6. Intellectual Property
We and our licensors retain all rights in the Services, including software, designs, trademarks, and documentation, except for User Content.
7. Plans, Billing, and Payments
Some parts of the Services may require paid plans. If you purchase a plan:
- Fees, billing cycles, and plan details will be presented at checkout.
- Payments are processed by third-party payment providers (e.g., Stripe).
- Taxes may apply depending on your location.
Refunds (if any) will be described in the plan or checkout terms.
8. No Guarantee of Results
The Services may help you implement strategies and optimizations, but we do not guarantee specific outcomes, including search engine rankings, traffic, revenue, or business results. Outcomes depend on many external factors beyond our control.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and merchantability.
10. Limitation of Liability
To the maximum extent permitted by law:
- We will not be liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim related to the Services will not exceed the amounts paid by you to us for the Services in the 12 months preceding the event giving rise to the claim (or $100 if you have not paid anything).
11. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if required for security or legal reasons.
12. Changes to the Services or Terms
We may update the Services and these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
13. Governing Law
Until MindSpectre’s corporate formation is finalized, these Terms are governed by the laws of France, without regard to conflict of law principles. Once the company is formed, we may update this section to reflect the applicable jurisdiction.
